Introduction
Please read this Terms and Conditions, Privacy Notice, and Cookies Information document (this “Agreement”) carefully before using any technology tool, website, or other technological integration operated or deployed by Inner Alchemy Psychotherapy, LLC (“Inner Alchemy,” “we,” “us,” or “our”). This includes www.InnerAlchemyPsychotherapy.com and any related pages, forms, portals, scheduling tools, intake tools, secure messaging features, downloadable materials, and online content that link to or reference this Agreement. Collectively, Inner Alchemy’s website and these tools are the “Site”.
Inner Alchemy provides remote psychotherapy-related services, including psychedelic preparation and integration support and psychotherapy related to love and attachment patterns, early relational and attachment trauma, the emotional dimensions of money and ambition, and living within or exploring kink, polyamory, and non-traditional relationships and lifestyles. Inner Alchemy’s offerings include remote preparation, integration, and guidance for clients undergoing ketamine-assisted psychotherapy (“KAP”), subject to applicable law, professional licensure limits, clinical appropriateness, and any separate informed consent or client services documentation.
Policy Purpose:
This Agreement sets forth (i) how you may use the Site, (ii) how Inner Alchemy collects, uses, and discloses personal information, including health-related and other sensitive information where applicable, and (iii) how we use cookies and similar technologies. This Agreement is a legally binding agreement between you and Inner Alchemy regarding your access to and use of the Site.
This Agreement applies only to the Site and online interactions with Inner Alchemy through the Site. Separate agreements, informed consent forms, telehealth consents, Notice of Privacy Practices under the Health Insurance Portability and Accountability Act of 1996, as amended (“HIPAA”), professional disclosures, financial policies, and client intake documentation may also apply to psychotherapy services, telehealth services, KAP-related services, and any patient portal or electronic health record platform. In the event of a conflict between this Agreement and a separately executed clinical or HIPAA-related document, the separate clinical or HIPAA-related document will control with respect to the subject matter covered by that document.
Article 1: Introduction and Scope
Your access to and use of the Site is conditioned on your acceptance of and compliance with this Agreement. By accessing or using the Site, you agree to be bound by this Agreement. If you do not agree to this Agreement, you do not have our permission to access or use the Site and must discontinue use immediately.
The Site may include educational content, service descriptions, blog posts, forms, scheduling functionality, newsletters, and general information related to psychotherapy, trauma, attachment, relationships, sexuality, altered states, and KAP-related preparation and integration. Unless expressly stated otherwise, Site content is provided for general informational purposes only and does not create a therapist-client relationship.
Article 2: Eligibility
As a condition of accessing or using the Site, you represent that:
you are at least 18 years of age;
you are legally able to enter into this Agreement; and
you will use the Site in compliance with this Agreement and applicable law.
Inner Alchemy does not knowingly collect personal information through the Site from anyone under 18 years of age. If you believe that a child has provided personal information to us through the Site, please contact us at inneralchemypsychotherapy@gmail.com or via the Contact Form at www.InnerAlchemyPsychotherapy.com.
Article 3: No Emergency Services; No Medical Advice; Scope Disclosures
The Site and any communications through the Site are not intended for emergency or crisis use. Inner Alchemy does not provide emergency services through the Site. If you are experiencing a medical emergency, psychiatric emergency, suicidal thoughts, risk of harm to yourself or others, or any urgent situation, call 911, go to the nearest emergency room, or contact the 988 Suicide & Crisis Lifeline or other local emergency resources immediately.
Inner Alchemy provides psychotherapy and related support services within the scope of applicable licensure and training. Unless expressly stated in a separate written agreement, Inner Alchemy does not prescribe, compound, dispense, furnish, sell, or administer ketamine or any other medication, does not supply psychedelic substances, does not direct medication dosing, and does not provide medical monitoring through the Site.
References to KAP, ketamine, psychedelic preparation, or psychedelic integration do not mean that Inner Alchemy is acting as your prescribing clinician, medical provider, pharmacy, infusion provider, emergency responder, or acute care provider. If you are receiving ketamine or another medication from a third-party prescribing or treating provider, that provider is solely responsible for prescribing decisions, medical screening, dosing, administration, monitoring, and medication-related instructions. If you are using psychedelics, you are responsible for complying with applicable law.
You are solely responsible for complying with the terms, rules, and technical requirements of any telehealth, patient portal, scheduling, or communications platform used in connection with services, the instructions of your prescribing or treating provider, and the laws and regulations applicable in the jurisdiction where you are located.
Any information on the Site (outside of that which is conveyed in your individual telehealth sessions) about mental health, trauma, attachment, relationships, ketamine, psychedelic experiences, or integration is educational in nature. It is not a substitute for individualized medical advice, diagnosis, or treatment. Inner Alchemy does not prescribe your medications or assess whether or not you should consume any substance. You should consult an appropriately licensed medical provider regarding medication use, substance use, contraindications, side effects, risks, and medical suitability for ketamine or any other treatment.
Article 4: Telehealth and Geographic Limitations
Inner Alchemy offers services remotely, and the availability of psychotherapy or consultation services may depend on your physical location at the time services are provided, applicable licensure laws, payer rules, platform rules, and clinical appropriateness.
You understand and agree that:
psychotherapy and related professional services may be offered only to individuals located in jurisdictions where Inner Alchemy is legally authorized to provide those services;
you may be asked to confirm your location before or during appointments;
Inner Alchemy may decline, reschedule, modify, or terminate services if your location, clinical presentation, platform access, or circumstances make remote care unavailable, unlawful, or clinically inappropriate; and
technology failures, connectivity issues, security incidents, and platform limitations may interfere with remote communications.
Nothing on the Site constitutes a representation that services are available in every state or jurisdiction.
Article 5: Acceptable Use
Your access to and use of the Site is limited, revocable, non-exclusive, and conditioned on your compliance with this Agreement. You agree that you will not use the Site or any related resources for purposes of:
engaging in, advocating, or promoting unlawful conduct;
harassing, abusing, stalking, threatening, defaming, or otherwise harming others;
transmitting malware, spyware, spam, phishing content, or other harmful code;
attempting to gain unauthorized access to the Site, our systems, accounts, or data;
interfering with the operation, integrity, or security of the Site; or
submitting false, misleading, or fraudulent information.
You also agree that you will not:
reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Site or related technology, except to the extent prohibited by law;
scrape, crawl, harvest, mirror, cache, index, or otherwise collect Site content or data using automated means, including bots, spiders, scrapers, AI agents, or similar technologies, except as expressly permitted by Inner Alchemy in writing;
use, copy, extract, or collect any Site content, data, materials, text, images, audio, video, forms, or other outputs to create, train, fine-tune, benchmark, or improve any machine learning model, dataset, or AI system, except as expressly permitted by Inner Alchemy in writing;
circumvent or attempt to circumvent any technical controls intended to restrict access or automated collection; or
use the Site in any way that infringes the rights of Inner Alchemy or any third party.
Inner Alchemy may suspend, restrict, or terminate access to the Site or take other appropriate action if we reasonably believe you have violated this Article.
Article 6: Intellectual Property
As between you and Inner Alchemy, all text, graphics, logos, designs, photographs, videos, audio, downloads, forms, compilations, software, functionality, and other content made available through the Site, and the selection and arrangement thereof, are owned by Inner Alchemy or its licensors and are protected by applicable intellectual property laws.
Except as expressly permitted by this Agreement, you may not reproduce, distribute, modify, publicly display, publicly perform, create derivative works from, republish, transmit, or exploit any portion of the Site without our prior written consent.
Without limiting the foregoing, you may not use any Site content, data, or materials, whether publicly accessible or behind a login, to create, train, fine-tune, benchmark, or improve any AI or machine learning model, except as expressly permitted by Inner Alchemy in writing.
Article 7: User Submissions
The Site may permit you to submit information through contact forms, consultation request forms, scheduling tools, intake forms, newsletter signups, or other interactive features. You are responsible for the accuracy of information you provide.
If you submit content, information, feedback, testimonials, reviews, comments, or other materials through the Site (“User Submissions”), you grant Inner Alchemy a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, and display those User Submissions as reasonably necessary to operate the Site, respond to your request, maintain business records, comply with law, and improve our services, subject to applicable confidentiality obligations and applicable law.
Please do not submit confidential, highly sensitive, or protected health information through general website forms unless the form expressly indicates that it is intended and appropriate for that purpose. General website contact forms, email, and similar channels may not be the appropriate method for transmitting urgent, highly sensitive, or clinically detailed information.
Article 8: Third-Party Services and Links
The Site may integrate with or link to third-party services, including scheduling platforms, payment processors, video conferencing tools, patient portals, forms providers, analytics tools, managed security providers, cloud hosting providers, and social media platforms. Inner Alchemy does not control and is not responsible for the privacy, security, availability, or practices of third-party services.
Inner Alchemy is a small team and may rely on qualified third-party vendors and service providers to support certain operational, technical, and security-related functions, including hosting, storage, threat detection, access controls, monitoring, communications, and incident response. Although we take reasonable steps to work with service providers we believe are appropriate for these functions, we cannot guarantee the performance or security of third-party systems.
Your use of third-party websites, platforms, or services is governed by the applicable third party’s terms and policies. We encourage you to review those terms and policies before using such services.
Article 9: Disclaimer
The content of the Site (outside of any content provided in an individual telehealth session) is provided for informational and educational purposes only. The Site may include content related to psychotherapy, trauma, attachment, relationships, sexuality, ketamine, altered states, and psychedelic preparation and integration. Such content is not intended to diagnose, treat, cure, or prevent any disease or condition and is not a substitute for individualized professional care.
Accordingly, as a condition of using the Site, you acknowledge and agree that:
use of the Site does not by itself create a therapist-client, physician-patient, fiduciary, or other professional relationship;
Site content may not be complete, current, or applicable to your circumstances;
Inner Alchemy makes no guarantee regarding any specific outcome, result, or benefit from use of the Site or any services described on the Site; and
decisions relating to your health, safety, treatment, medications, relationships, legal status, and finances should be made with appropriately qualified professionals.
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, INNER ALCHEMY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
Article 10: Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INNER ALCHEMY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SITE OR THIS AGREEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INNER ALCHEMY’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THIS AGREEMENT WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID, IF ANY, TO USE THE SITE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
Some jurisdictions do not allow certain limitations of liability, so portions of this Article may not apply to you.
Article 11: Indemnification
You agree to indemnify, defend, and hold harmless Inner Alchemy and its members, managers, officers, directors, employees, contractors, agents, licensors, successors, and assigns from and against any and all claims, demands, actions, proceedings, damages, losses, liabilities, judgments, settlements, penalties, fines, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:
your access to or use of the Site;
your violation of this Agreement;
your violation of applicable law or the rights of any third party; or
any information or materials you submit through the Site.
Inner Alchemy may assume the exclusive control of the defense and settlement of any matter subject to indemnification by you, and you will cooperate as reasonably requested. You may not settle any such matter without Inner Alchemy’s prior written consent if the settlement imposes any liability or obligation on Inner Alchemy or restricts any of its rights.
Article 12: Governing Law and Venue
This Agreement is governed by the laws of the State of New York without regard to conflict of laws principles.
The sole and exclusive forum for any dispute, claim, or controversy arising out of or relating to this Agreement or your use of the Site will be the state or federal courts located in New York County, New York, and you submit to the personal jurisdiction of those courts and waive any objection based on inconvenient forum, except to the extent otherwise required by applicable law.
Nothing in this Agreement limits any rights you may have that cannot be waived under applicable law.
Article 13: Changes to This Agreement
Inner Alchemy may revise, amend, or update this Agreement from time to time in its discretion. When we do so, we will update the Effective Date or Last Revised date above. Your continued use of the Site after any update becomes effective constitutes your acceptance of the revised Agreement, to the extent permitted by law.
If we make material changes that require additional notice or consent under applicable law, we will provide that notice or obtain that consent as required.
Article 14: Severability; Waiver; Entire Agreement
If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by law.
No waiver of any provision of this Agreement will be deemed a further or continuing waiver of that provision or any other provision.
This Agreement constitutes the entire agreement between you and Inner Alchemy with respect to your use of the Site, except for any separate agreement, informed consent, Notice of Privacy Practices, financial policy, telehealth consent, or other written terms that apply to specific services or relationships.
